Terms and Conditions

These Terms and Conditions (“Terms”) govern your access to and use of the Jim AI mobile application and related services (collectively, the “Service”).

By creating an account, subscribing, or otherwise using the Service, you agree to these Terms and our Privacy Policy (available at https://getjimapp.com). If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old (or the minimum age required in your country) to use the Service. If you are under 18, you represent that you have permission from a parent or legal guardian. The Service is not intended for individuals who cannot safely participate in physical exercise without medical supervision.

2. The Service

Jim AI is a workout companion that helps you log exercises, build routines, track progress, receive AI-powered training suggestions, and optionally connect with Apple Health. We may update, modify, suspend, or discontinue any part of the Service at any time, with or without notice.

3. Accounts and Security

To use most features, you must create an account using Sign in with Apple, email and password, or other methods we support. You are responsible for providing accurate account information, maintaining the confidentiality of your login credentials, and all activity that occurs under your account. Notify us immediately at hello@getjimapp.com if you believe your account has been compromised.

4. Subscriptions and Payments (Jim AI Pro)

Some features require a paid subscription (“Jim AI Pro” or similar).

  • Subscriptions are processed through Apple’s App Store (via RevenueCat).

  • Payment is charged to your Apple ID account at confirmation of purchase.

  • Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.

  • Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.

  • You can manage or cancel subscriptions in your Apple ID Account Settings: Settings > [Your Name] > Subscriptions.

  • Any free trial, if offered, converts to a paid subscription unless canceled before the trial ends. Unused trial time is forfeited when you purchase a subscription, where applicable.

  • Refunds are handled by Apple according to Apple’s policies. We do not control Apple’s refund decisions.

Pricing, features, and subscription tiers may change. We will provide notice where required by law or platform policy.

5. Free Tier Limits

If you use the free version of Jim AI, certain features may be limited (for example, number of routines, AI recommendations, or progress history). Limits may change over time.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose.

  • Attempt to gain unauthorized access to our systems or other users’ accounts.

  • Reverse engineer, scrape, or misuse the Service except as permitted by law.

  • Upload harmful, abusive, or infringing content.

  • Use the Service in a way that could harm us, other users, or third parties.

We may suspend or terminate your account if you violate these Terms.

7. AI Features and Recommendations

Jim AI may provide workout suggestions, program generation, and training recommendations using automated systems, including third-party AI services. You understand and agree that AI outputs are suggestions only and may be incomplete, inaccurate, or unsuitable for your individual circumstances; you are solely responsible for deciding whether to follow any recommendation; AI features may use information you provide (such as workout history, goals, experience level, injuries, and preferences) to generate suggestions; and we do not guarantee specific fitness results from use of the Service or AI features.

8. Health and Fitness Disclaimer (Important)

PLEASE READ THIS SECTION CAREFULLY BEFORE USING THE SERVICE. Consult a doctor or qualified healthcare professional before beginning a new workout program, especially if you have pre-existing conditions or injuries. Our training program does not replace professional medical advice. By continuing, you acknowledge that you’re responsible for your own health and well-being.

a) Not Medical Advice

Jim AI is a fitness and wellness tool only. It does not provide medical advice, diagnosis, treatment, or emergency services. Nothing in the Service should be interpreted as a substitute for professional medical or healthcare advice.

b) Assumption of Risk

Physical exercise involves inherent risks, including injury, illness, or death. You voluntarily assume all risks associated with your use of the Service and any workouts you perform.

c) Listen to Your Body

Stop exercising immediately and seek medical attention if you experience pain, dizziness, shortness of breath, chest discomfort, or any other concerning symptoms.

d) Injury and Health Information

If you provide injury or health-related information (for example during onboarding or in your profile), you represent that it is accurate to the best of your knowledge. We use this information to personalize suggestions but do not verify its accuracy and do not provide clinical review.

e) Apple Health

If you connect Apple Health, data is used to enhance your experience (such as reading or writing workout and energy data). Apple Health integration is optional and controlled by your device permissions. We are not responsible for data accuracy from third-party devices or apps connected to Apple Health.

f) No Emergency Use

The Service is not designed for emergency situations. Call your local emergency number if you need urgent medical help.

9. Intellectual Property

The Service, including software, design, branding, text, graphics, and content (excluding your User Content), is owned by us or our licensors and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes in accordance with these Terms.

10. Your Content

You retain ownership of content you submit (such as workout logs, notes, custom exercises, profile information, and photos you upload). You grant us a worldwide, non-exclusive license to host, store, process, display, and use your content solely to operate, improve, and provide the Service (including AI features), and as described in our Privacy Policy. You represent that you have the rights to any content you submit and that it does not violate any third-party rights or applicable laws.

11. Third-Party Services

The Service integrates with third-party services, which may include Apple (Sign in with Apple, App Store, Apple Health), Supabase (authentication and cloud data storage), RevenueCat (subscription management), Anthropic or other AI providers (workout recommendations and program generation), and notification services provided by Apple. Your use of third-party services may be subject to their own terms and privacy policies. We are not responsible for third-party services outside our control.

12. Account Deletion

You may delete your account through the app (where available). Account deletion is intended to remove your authentication account and associated personal data, subject to legal retention requirements and technical limitations. Some information may persist temporarily in backups or logs before being deleted according to our standard retention practices.

13. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT AI RECOMMENDATIONS WILL BE ACCURATE OR SAFE FOR YOU.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD $100. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

15. Indemnification

You agree to indemnify and hold us harmless from claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your User Content, or your violation of these Terms or applicable law.

16. Termination

You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms, if required by law, or to protect the Service or other users. Sections that by nature should survive termination (including health disclaimers, intellectual property, disclaimers, limitation of liability, and governing law) will survive.

17. Changes to These Terms

We may update these Terms from time to time. If changes are material, we will provide notice as required by law (for example, in-app notice or by updating the Effective Date). Continued use after changes become effective constitutes acceptance of the updated Terms.

18. Governing Law and Disputes

These Terms are governed by the laws of the State of New Jersey, United States, without regard to conflict-of-law principles. Any dispute will be resolved in the courts located in New Jersey, United States, unless applicable law requires otherwise.
